Kuwait Court of Cassation principle number 964

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered by the court of first instance as final judgments may not be appealed. Judgments affected by procedural nullity that influenced the judgment are excepted from that rule. - The final-jurisdiction monetary limit of the Court of First Instance. Five thousand dinars. Article 34 of the Civil Procedure Law. - An action is valued as at the day it is brought and on the basis of the latest claims. - Actions brought seeking relief incapable of valuation. Deemed to exceed five thousand dinars. Example. - 183 - Civil Procedure - The first-instance judgment on the merits. Necessarily includes an implicit ruling on jurisdiction. That implicit ruling becomes protected by res judicata. Its issuance in violation of the rules of jurisdiction does not detract from that. The reason therefor. The precedence of res judicata over considerations of public policy.
