State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding effect of a criminal judgment before civil courts. Its conditions: its necessarily deciding the substance of the act constituting the common basis of the criminal and civil actions, the legal characterization of the act - 263 - Procedure and its attribution to its perpetrator. Fulfilment of that. Prevents the civil court from re-examining them and requires adherence to them when examining civil rights. - The criminal judgment’s conclusion that the elements of liability, comprising fault and damage of both types, are present. Prevents the civil court from re-examining those elements. Contravening that and dismissing the compensation action—for the same act and the person responsible for it—on the ground that damage has not occurred. An error in applying the law. Requires its cassation.
