Cassation of a judgment and remittal of the case to the court that issued it for a fresh judgment therein. Its implication. That court must follow the judgment of the Court of Cassation on the legal issue which it determined and on which it expressed its opinion deliberately and with insight, thereby giving its judgment the force of res judicata concerning that issue, and the court of remittal may not encroach upon that binding effect. - 335 - Civil Procedure

تمييز الحكم وإحالة القضية إلى المحكمة التي أصدرته للحكم فيه من جديد. مقتضاه. أنه يتحتم على تلك المحكمة أن تتبع حكم محكمة التمييز في المسألة القانونية التي فصلت فيها وأدلت فيها برأيها عن قصد وبصر مما يكسب حكمها قوة الشيء المحكوم فيه بشأنها ويمتنع على محكمة الإحالة المساس بهذه الحجية. - ٣٣٥ - المرافعاتOriginal Arabic judgment citations
