English translation of the principle

A dispute over the validity or invalidity of compulsory sale procedures. An indivisible subject matter. The judgment awarding the sale is issued in favour of the purchaser to whom the auction was awarded. A ruling declaring it void or annulling it. Its effect. Dissolution and extinction of the sale from the time it was awarded, extinguishment of the purchaser's ownership, and its reversion to the original owner. Its necessary consequence. He must be joined in the challenge to the judgment, even if he was not a party to the procedures preceding the award of the sale, as he is a judgment beneficiary. The appellant's restricting his challenge to the creditor and the debtor whose property was attached, the owner of the real property, without joining the successful bidder who intervened in the appeal. Its effect. Invalidity of the appeal.
