Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3979

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Levying attachment of the debtor's property in the hands of a third party entails the total withholding of the attached property in the latter's hands, regardless of its value. The garnishee may not pay this property to his creditor against whom attachment is levied. He must deposit the property in the treasury of the Enforcement Department or merely declare his indebtedness at the registry of the Plenary Court within ten days from the date of service of the attachment upon him in the latter case, and, ten days after the date of the declaration, pay the attaching creditor the amount he acknowledged or so much thereof as satisfies the attaching creditor's right. The garnishee's failure to follow this approach constitutes a breach by him of a statutory obligation. The effect thereof.
