Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4208

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Pleading in its technical sense. Means an oral explanation by the litigant or his lawyer of the viewpoint concerning the allegations, defences, or grounds presented before the court by the person who authorized him to plead or by his adversary. - Granting a person the right to plead. Does not inevitably and necessarily entail granting him the right to sign pleadings. The rationale: nothing in the law requires the lawyer signing the pleading to be retained by the claimant or to conduct the action himself. - Signing the pleading. Is not considered part of oral pleading procedures. The rationale for that. The challenged judgment’s adherence to this view. Correct in law.
