Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4209

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The legislature's exhaustive specification of the judicial documents which it requires to be signed by an admitted lawyer and its imposition of nullity for contravention thereof in clear and explicit language. Article 18 of Law 42 of 1964 concerning the regulation of the legal profession, as amended. A joinder pleading falls outside the scope of this specification. Its implication: its validity does not require that it be signed by a lawyer. The challenged judgment's adherence to this view and rejection of the plea that the joinder pleading was void for lack of a lawyer's signature, by analogy with a statement of claim. Correct.
