Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2273

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The trial judge's right to infer whether or not a contracting party breached his obligation so as to entail contractual liability. Its condition. The inference must be tenable and derived from elements leading to it. Example of a defective inference of a warehouse owner's liability for a fire therein without examining her defence based on his performance of her contractual obligations and without specifying the nature of her breach of her obligations, with incoherent and conflicting reasons concerning the cause of the fire.
