Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2506

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The insurer and the third party responsible for the accident being liable for the same debt, although the source of each obligation differs—the first being the insurance contract and the second the wrongful act. Its effect: their concurrent liability for its payment. The implication thereof: the injured party's recourse against the insurance company to recover compensation does not deprive that party of the right of recourse against the person who caused the harm.
