Creation of a commercial instrument as a means of discharging a prior obligation. Its effect. A new obligation arises, namely the negotiable-instrument obligation, alongside and independent of the original obligation. The creditor has the choice of proceeding against the debtor by an action on the instrument or by an action on the original debt. Extinction of the first action by limitation. Does not affect the second action.

إنشاء الورقة التجارية كأداة للوفاء بالتزام سابق. أثره. نشأة التزام جديد هو الالتزام الصرفي إلى جوار الالتزام الأصلي ومستقل عنه. للدائن الخيار في الرجوع على المدين بدعوى الصرف أو بدعوى الدين الأصلي. انقضاء الدعوى الأولى بالتقادم. غير مؤثّر على الدعوى الثانية.Original Arabic judgment citations
