Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3524

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The negotiable-instrument obligation and the underlying obligation in commercial instruments. Their source is one. The implication thereof is that defenses arising from the underlying obligation transfer, as between the debtor and his immediate creditor, to the negotiable-instrument obligation. Its effect: the debtor under commercial instruments, including a cheque, may invoke the same defenses by which the underlying action may be resisted.
