Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4247

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Oil operations have a special character requiring their continuation for a full twenty-four hours. Working hours, including overtime hours, may not exceed forty-eight hours in a single week. The condition for this. The worker must remain near the worksite during his rest period after the shift so that he may readily be called upon when necessary, without being entitled during that period to additional pay for hours other than the working hours during which he performs work. Example of sound reasoning for rejecting a claim for overtime pay. - 828 - Labour
