English translation of the principle

The contracting parties’ use of a printed form for the contract or instrument, adding to it by hand or by any other means conditions or expressions conflicting with the printed form. The added conditions and expressions must prevail. The rationale thereof: they are regarded as a clear expression of the contracting parties’ intent. An example concerning the worker’s reservation, in the body of the release, of his entitlement to claim any financial or labour rights that emerge in the future.
