Criminal intent in the offence of issuing a cheque without funds. General intent. The extent of the beneficiary's entitlement to the cheque or the reason for its issuance. Has no effect on criminal liability and the judgment of conviction. The implication thereof: the challenge to the judgment for not staying the civil action until the criminal action is determined is unfounded.
