1 - If a simulated contract is concluded, the creditors of each of the two contracting parties and the particular successor of either of them may prove the simulation by all means and invoke the concealed contract. They may also invoke the simulated contract if they were unaware of the simulation. - If the interests of the persons concerned conflict, with some invoking the simulated contract and others invoking the concealed contract, preference shall be given to the former. ١ - إذا أبرم عقد صوري ، كان لدائني كل من التعاقدين وللخلف الخاص لأي
منهما أن يثبتوا الصورية بجميع الوسائل ويتمسكوا بالعقد المستتر ، كما أن لهم أن
يتمسكوا بالعقد الصوري إذا كانوا لا يعلمون بالصورية.
- وإذا تعارضت مصالح ذوي الشأن, بأن تمسك البعض بالعقد الصوري، وتمسك
الآخرون بالعقد المستتر, كانت الأفضلية للأولين.
