Article 239 of Civil Code

1 - The State's liability shall replace the teacher's liability. If the teacher works in a private school or institute, the liability of the owner of the school or institute shall replace his liability. 2 - Neither the State nor the owner of the school or institute may have recourse against the teacher for what it pays to the injured person, even if recovery from the pupil's own property is impossible, unless fault on the teacher's part is established.
