Article 238 of Civil Code

1 - Every person required by law or agreement to supervise a person in need of supervision because of his minority or his mental or physical condition shall be obliged, vis-à-vis the injured party, to compensate for the damage caused to him by that person's unlawful act, unless he proves that he duly performed the duty of supervision or that the damage would inevitably have occurred even if he had performed that duty. 2 - A minor shall be considered in need of supervision if he has not reached fifteen years of age, or has reached that age and is in the care of the person responsible for his upbringing. 3 - Supervision of a minor shall pass to his teacher at school or his supervisor in a trade for as long as the minor remains under the supervision of the teacher or supervisor. 4 - Supervision of a minor wife shall pass to her husband or to the person supervising the husband. 974 Law Index Home Page Civil Code Decree-Law No. 67 of 1980 AD promulgating the Civil Code
