English translation
1 - If the debtor is required to preserve or administer a thing, or to exercise caution in performing his obligation, he shall have fulfilled the obligation if he exercises in its performance the care of an ordinary person, even if the intended purpose is not achieved. This applies unless the law or agreement provides otherwise. 2 - In all cases, the debtor shall be liable for any fraud or gross fault committed by him.

١ - إذا كان المطلوب من المدين أن يحافظ على شيء أو أن يقوم بإدارته، أو كان المطلوب
أن يتوخى الحيطة في تنفيذ التزامه، فإنه يكون قد وفى بالالتزام إذا بذل في تنفيذه
عناية الشخص العادي، ولو لم يتحقق الغرض المقصود. هذا ما لم ينص القانون أو
الاتفاق على غير ذلك.
٢ - وفي كل حال يكون المدين مسئولاً عما يأتيه من غش أو خطأ
