English translation
1 - If the debtor's disposition is for consideration, its ineffectiveness against the creditor shall require fraud on the debtor's part and the disponee's knowledge of that fraud. The debtor's fraud shall be presumed if the creditor proves that, at the time of the disposition, the debtor knew that he was insolvent or ought to have known this. Likewise, the disponee's knowledge of the debtor's fraud shall be presumed if the creditor proves that, at the time of the disposition, the disponee knew that the debtor was insolvent or ought to have known this. 2 - If the debtor's disposition is gratuitous, neither the debtor's fraud nor the disponee's good faith shall be a requirement for its ineffectiveness against the creditor.
