Article 353 of Civil Code

1 - In all cases in which the creditor releases one of the joint and several debtors, whether from the debt or from joint and several liability, the remaining debtors may, where appropriate, have recourse against that debtor for his portion of the share of an insolvent debtor among them, in accordance with Article 359. 2 - However, if the creditor absolves the released debtor of all liability for the debt, the creditor shall bear that debtor's portion of the insolvent debtor's share.
