Article 359 of Civil Code

1 - If one of the joint and several debtors pays the entire debt or more than his share thereof, or discharges it by a means equivalent to payment, he may have recourse against any debtor only to the extent of that debtor's share, even if the payer has pursued the creditor's action on the basis of his right of subrogation. 2 - If one debtor pays the debt, it shall be divided into equal shares among all of them, unless an agreement or statutory provision provides otherwise. - If one joint and several debtor becomes insolvent, the debtor who paid the debt and all the other debtors shall bear the consequences of that insolvency, each in proportion to his share.
