Article 392 of Civil Code

1- For performance to be valid, the person rendering performance must own the thing with which he renders performance and have capacity to dispose of it. 2- Nevertheless, performance by a person of diminished capacity of something due from him shall be valid if the performance causes him no harm. 3- If the debtor pays the debt of some creditors during his death illness, and his assets are insufficient to pay all his debts, and payment of the debt consequently harms the remaining creditors, the payment shall not be effective against those remaining creditors.
