Article 425 of Civil Code

1 - The debtor has the right to set off what he owes his creditor against what that creditor owes him, even if the causes of the two debts differ, provided that the subject matter of each is money or fungibles of the same kind and quality, and each is undisputed, due for payment, and enforceable in court. - Set-off is not precluded by the time for payment having been deferred pursuant to a period of grace granted by the judge or voluntarily allowed by the creditor.
