English translation
If the law requires a particular form, or the contracting parties agree that it is mandatory, and doubt arises as to whether that form is required for the formation of the contract or for another of its matters, it must not be regarded as a requirement for the formation of the contract.

إذا استلزم القانون شكلا معينا, أو اتفق المتعاقدان على وجوبه, وثـار الـشـك حـول
ما إذا كان هذا الشكل متطلبا لقيام العقد أو لغير ذلك من أموره, وجب عدم
