Without prejudice to the preceding Article, there shall be no warranty if there is an express agreement exempting it in the particular case from which it arose, or if the third-party entitlement is attributable to the fault of the co-partitioner himself. Third: Partition of usufruct:

مــع عــدم الإخلال بما تــقضي بــه المادة الســابقة لا يكــون للــضمان محــل إذا وجــد اتفــاق
صريــح على الإعفــاء منــه في الحالــة الخاصــة التــي نشــأن عنهــا أو كان الاســتحقاق راجعــا
إلى خطــأ المتقاســم نفســه.
