Article 840 of Civil Code

1 - Each party to a partition warrants to the other against interference with or eviction from the allotment assigned to him for a cause preceding the partition. 2 - If a party is evicted from all or part of his allotment, he may request rescission of the partition and a new partition if this is possible without prejudice to the other parties to the partition or third parties. If he does not request rescission or a new partition is impossible, the person entitled to the warranty has recourse against the other parties to the partition for the amount by which his allotment diminished, on the basis of the value of all the partitioned property at the time of eviction. Each party to the partition shall be liable in proportion to his share. If one of them is insolvent, the amount for which he is liable shall be distributed among the person entitled to the warranty and all the parties to the partition who are not insolvent.
