Article 837 of Civil Code

1 - The co-owners must, whether the partition is judicial or consensual, join the creditors whose rights were publicized before the action was brought or before the consensual partition was concluded; otherwise, the partition shall be ineffective against them. 2 - The creditors of each co-owner may object to the judicial partition being carried out in their absence. The objection shall be by formal notice addressed to all the co-owners. The co-owners must join the creditors who have objected in the action; otherwise, the partition shall be ineffective against them.
