Article 834 of Civil Code

1 - Allotments shall be formed on the basis of the smallest share, even if the partition is partial. 2 - Each co-owner's allotment must be set apart for him if the co-owners agree to this or partition on the basis of the smallest share is impossible. 3 - Any shortfall in the value of an allotment in kind may be made up by an equalization payment made by the person receiving an allotment greater than the value of his share.
