Article 832 of Civil Code

1 - A co-partitioner has the right to seek annulment of a partition effected by mutual consent if it causes him a shortfall exceeding one-fifth, and the assessment shall be based on the values of the things at the time of partition. 2 - The action for annulment shall lapse upon the passage of one year from the time of partition. 3 - The defendant may prevent annulment if he makes up to the plaintiff, in cash or in kind, what is deficient in Index of the Law 1052 Home Page Civil Code Decree-Law No. 67 of 1980 AD Promulgating the Civil Code his share.
