Article 830 of Civil Code

English translation

1 - Each co-owner may request partition of the property held in common unless he is compelled to remain in co-ownership by law or by a disposition. Compulsion to remain in co-ownership by virtue of a legal disposition may not extend beyond five years. If the term does not exceed this period, the compulsion shall apply to the co-owner and his successors. 2 - Nevertheless, the court may, at the request of one of the co-owners, order that co-ownership be maintained for a period it determines or continued until a date later than the stipulated date, whenever immediate partition would be detrimental to the interests of the co-owners. It may also order partition before expiry of the stipulated term if there is a compelling reason justifying it.
