يسقط الحق في الأخذ بالشفعة:
أ) إذا نزل الشفيع عن حقه في الأخذ بالشفعة صراحة أو ضمنا.
ب) إذا لم يعلن الشفيع رغبته في الأخذ بالشفعة خلال ثلاثة أشهر مـن يـوم تسجيل
البيع إن كان المبيع عقارا.
