English translation
If the mortgagor does not own the mortgaged property, the mortgage contract shall not be effective against the owner unless he ratifies it by an official instrument authenticated in accordance with the law. If such ratification is not issued, the mortgage right shall attach to the property only from the time that property becomes owned by the mortgagor.

إذا كان الراهن غير مالك للعقار المرهون، فإن عقد الرهن لا ينفذ في حق المالك إلا
إذا أقره بورقة رسمية موثقة وفقا للقانون، وإذا لم يصدر هذا الإقرار، فإن حق الرهن
