1 - The mortgage shall be accessory to the secured debt as regards its validity and extinguishment, unless the law provides otherwise. 2 - If the mortgagor is not the debtor, he may, in addition to invoking his own defences, invoke the debtor's defences relating to the debt, and shall retain this right even if the debtor waives it. ۱ - يكون الرهن تابعا للدين المضمون في صحته وفي انقضائه، ما لم ينص القانون
على غير ذلك.
۲ - وإذا كان الراهن غير المدين، كان له إلى جانب تمسكه بأوجه الدفع الخاصة به أن
يتمسك بما للمدين من أوجه الدفع المتعلقة بالدين، ويبقـى لـه هـذا الحق ولـو نـزل
