Article 980 of Civil Code

1 - If one of the co-owners mortgages all or part of his undivided share in an immovable property, the mortgage shall, after partition, encumber what falls to the mortgagor's share, or a portion of what falls to his share equivalent in value to the mortgaged share. This portion shall be designated by an order on petition. 2 - This mortgage shall retain its rank if a new entry is made for it within sixty days from the time any interested party notifies the mortgagee of the registration of the partition. The retention of the mortgage's rank in this manner shall not prejudice a mortgage granted by all the co-owners or the privilege of the partitioning co-owners.
