Article 114 of Code of Criminal Procedure and Trials

Every civil claimant before the criminal courts may, at any stage of the proceedings, abandon his civil action before the criminal courts. Such abandonment shall not affect his right to bring his action before the civil courts, unless, upon withdrawal, he expressly waives the civil right. The civil claimant's withdrawal of his action shall likewise not affect the rights against him of the accused or the person liable for civil damages, nor prevent the court from ordering him to pay costs if it considers this appropriate. The civil claimant's failure to appear without excuse shall permit the court to rule that he is deemed to have abandoned his action.
