English translation
The Public Prosecutor may request the Misdemeanours Court to issue a penal order imposing punishment on the accused in a misdemeanour punishable by no more than imprisonment for a term of one year on the accused in a misdemeanour punishable by no more than a dinar. This shall be by a statement of claim indicating that what is requested is its determination by a penal order, and all papers and records supporting the accusation shall be attached to the statement. The court shall determine this request in the absence of the accused by summary procedure, without the need for an investigation at the hearing, confining itself to examining the papers and the records of inquiries or investigation; however, it may not impose any punishment other than a fine not exceeding one hundred dinars.

يجــوز للمدعــى العــام أن يطلــب مــن محكمــة الجنــح إصــدار أمــر جزائــي بالعقوبــة على
المتهــم في جنحــة لا تزيــد عقوبتهــا على الحبــس مــدة ســنة على المتهــم في جنحــة لا تزيــد
عقوبتهــا على دينــار.
ويكــون ذلــك بعريضــة دعــوى مــع بيــان أن المطلــوب هــو الفصــل فيهــا بأمــر جزائــي،
ويرفــق بالعريضــة جميــع الأوراق والمحــاضر المؤيــدة للاتهــام.
وتفصــل المحكمــة في هــذا الطلــب في غيبــة المتهــم بطريقــة موجــزة دون حاجــة إلى تحقيــق
بالجلســة، اكتفــاء بــالاطلاع على الأوراق ومحــاضر التحريات أو التحقيــق، ولكن لا يجوز
