Records of investigations preceding the trial may be added to the case file. These records shall have no evidentiary authority before the courts, but the court may make use of them as follows: 1- By relying on them to infer circumstantial indications justifying or requiring a particular investigative procedure. 2- By using elements derived from them in questioning witnesses, experts or accused persons. 3- By summoning the investigator as a witness and questioning him, after he has taken the oath, about what he recorded in the report.

يجــوز ضــم محــاضر التحقيقــات الســابقة على المحاكمــة إلى ملــف القضيــة ولا يكــون لهــذه
المحــاضر حجيــة في الإثبــات أمــام القضــاء وإنما يجــوز للمحكمــة الاســتفادة منهــا على
النحــو الآتي:
١- أن تعتمــد عليهــا في اســتخلاص القرائــن المبررة أو الموجبــة للقيــام بإجــراء مــعين مــن
إجــراءات التحقيق.
2- أن تستخدم العناصر المستمدة منها في مناقشة الشهود أو الخبراء أو المتهمين.
3- أن تستدعي المحقق كشاهد وتناقشه فيما أثبته في المحضر بعد حلف اليمين.Ask about this article
