English translation
If the investigator has evidence or indications that a particular person possesses papers, effects or any other thing connected with the crime he is investigating or useful to its investigation, he may issue an order requiring the possessor to surrender that thing, produce it or enable the investigator to inspect it, in the manner he specifies and at the place and time designated in the order he issues. The order shall be served on the person required to comply in the manner in which a summons is served. If the person subject to the order does not comply with the order served on him at the appointed time, the investigator may order a search, seizure or any other act of public authority to obtain possession of that thing in the interests of the investigation. If it is established to the investigator that the person to whom the order was addressed has refrained from complying with it without an acceptable excuse, or has performed any act intended to spirit away that thing or prevent its seizure, he may refer him to the court to sentence him to the penalty for refusal to testify, if he is not an accused in the case. إذا توافرت لدى المحقق ادلة او قرائن على ان شخصا معينا يحوز اوراقا او امتعة او
أي شيء آخر له علاقة بالجريمة التي يحقق فيها او يفيد في تحقيقها، فإن له ان يصدر
امرا بتكليف الحائز بتسليم ذلك الشيء او تقديمه او تمكين المحقق من الاطلاع
عليه، بالطريقة التي يحددها، وفي المكان والزمان المعينين في الامر الذي يصدره،
ويعلن الامر للمكلف بالطريقة التي يقع بها اعلان الامر بالحضور. وإذا لم ينفذ
المكلف بالأمر الأمر المعلن اليه في موعده، جاز للمحقق ان يأمر بإجراء تفتيش او
ضبط او أي عمل آخر من اعمال السلطة العامة لوضع يده على هذا الشيء لمصلحة
التحقيق. وإذا ثبت للمحقق ان الموجه اليه الامر قد امتنع عن تنفيذه بغير عذر
مقبول، او انه قام بأي عمل يقصد به تهريب ذلك الشيء او منع ضبطه، جـاز لــه
ان يقدمه للمحكمة للحكم عليه بعقوبة الامتناع عن الشهادة إذا لم يكن متهما في
القضية.
