English translation
In cases of exposure to delinquency and in felonies and misdemeanors, and before deciding the juvenile's matter, the court must hear the statements of the probation officer after he submits a report on the juvenile's condition explaining the factors that drove him to delinquency or exposure thereto and his proposals for reforming him. The court may also seek the opinion of experts. Article 39 (1) Where there are multiple persons accused of committing a felony, including one or more juveniles and others over eighteen years of age, all shall be referred to the court having original jurisdiction, provided that the provisions of this Law are applied to the juvenile. In this case, before delivering its judgment against the juvenile, the court must examine his circumstances in all respects, and may seek assistance therein from such experts or probation officers at the Social Supervision and Aftercare Office as it sees fit. Where there are multiple persons accused of committing a misdemeanor unrelated to a felony, or where the juvenile has not attained fifteen years of age and is accused of committing a felony or misdemeanor, the juvenile must be brought before the Juvenile Court and the others shall be referred to the competent court.
