English translation
A waqf may not be sold except in the following cases: 1 Where it becomes ruined such that it cannot be used while its corpus remains intact. 2 Where the founder stipulates its sale upon the occurrence of a matter such as diminished benefit, the existence of a significant interest, or the like. 3 Where severe disagreement arises among the beneficiaries, such that loss of lives and property cannot be ruled out. 4 Where it is known that the founder regarded a particular character in the endowed asset as essential to the waqf, and that character disappears; sale shall then be permissible even if the benefit remains unchanged or is greater. 5 Where part of the waqf becomes ruined, that part shall be sold and its price spent for the benefit of the usable portion, or on another waqf if it is endowed in the same manner as the ruined waqf.
