English translation
a. A bequest may validly be made effective in the future, made contingent on a condition, or restricted by it if the condition is valid. b. A valid condition is one involving a lawful interest for the testator, the legatee, or another person, which is not prohibited and is not contrary to the purposes of Sharia. It must be observed so long as the intended interest is realized or predominant. c. If a bequest is made contingent on an invalid condition, it shall be void. d. If a bequest is restricted by an invalid condition, the bequest shall be valid and the condition shall be disregarded.

أ- تصح اضافة الوصية الى المستقبل ، او تعليقها على الشرط ، او تقييدهـا بـه إذا كان
الشرط صحيحا.
ب - الشرط الصحيح ما كان فيه مصلحة مشروعة للموصي او للموصي له ، او
لغيرهما ، ولم يكن منهيا عنه ، ولا منافيا لمقاصد الشريعة ، وتجب مراعاته ، ما دامت
المصلحة المقصودة به متحققة او غالبة.
ج - إذا علقت الوصية على شرط غير صحيح كانت باطلة.
د- إذا قيدت الوصية بشرط غير صحيح ، صحت الوصية ، ولغا الشرط .Ask about this article
