English translation
a- The testator must have legal capacity to make a gratuitous disposition. b - If the testator is under interdiction for prodigality or heedlessness, or has attained eighteen years of age, his will shall be permissible with the court's permission or approval. c - A will made by a person under interdiction before interdiction for prodigality or heedlessness does not require permission for its continuation. d - The will of a male or female apostate shall be effective if they return to Islam. أ- يشترط في الموصي ان يكون اهلا للتبرع قانونا.
ب - إذا كان الموصي محجورا عليه لسفه او غفلة ، او بلغ من العمر ثماني عشر سنة ،
جازت وصيته بإذن من المحكمة او اجازتها.
ج - الوصية الصادرة من المحجور عليه قبل الحجر للسفه او للغفلة لا يحتاج
استمرارها الى اذن.
د - وصية المرتد والمرتدة نافذة إذا عادا الى الاسلام .
