English translation
a- The bequest of a debtor whose assets are exhausted by debt is valid, but shall not be given effect unless his liability for that debt is discharged. b- If his liability for part of the debt is discharged, or the debt does not exhaust his assets, the bequest shall take effect in one-third of the remainder after the debt is extinguished or paid.
Arabic original
أ- تصح وصية المدين المستغرق ماله بالدين ، ولا تنفذ الا ببراءة ذمته منه.
ب فان برئت ذمته من بعض الدين ، او كان الدين غير مستغرق نفذت الوصية
