English translation
The charging of a bequest of usufructs and rights against one-third of the estate shall be calculated as follows: a- If the bequest of usufructs is perpetual, unrestricted, for the lifetime of the legatee, or for a period exceeding ten years, then, in a bequest of all the usufructs of the property, the usufructs shall be deemed equal to the value of the property itself; and in a bequest of a proportional share of the usufructs, they shall be deemed equal to the corresponding proportion of the designated property. b- If the bequest of the beneficial is for a period not exceeding ten years, it shall be valued at the value of the usufruct bequeathed during that period. يحسب خروج الوصية بالمنافع والحقوق من ثلث التركة كما يلي :
أ- إذا كانت الوصية بالمنافع مؤبدة ، او مطلقة ، او لمدة حياة الموصي له ، او لمدة
تزيد على عشر سنين ، ففي الوصية بجميع منافع العين ، تعتبر المنافع مساوية لقيمة
العين نفسها ، وفي الوصية بحصة نسبية من المنافع تعتبر مساوية لنظير هذه النسبة
من المعين.
ب- إذا كانت الوصية بالنافع لمدة لا تزيد على عشر سنين ، قدرت بقيمة المنفعة
الموصي بها في هذه المدة.
ج - إذا كانت الوصية بحق من الحقوق العينية ، قدرت بالفرق بين قيمة العين
