Article 324 of Personal Status Law

In the first group of the groups of the fourth class specified in Article 320, if the father's side alone is present, namely the deceased's paternal uncles related to his father through the mother and his paternal aunts, or the mother's side alone, namely his maternal uncles and maternal aunts, those with the strongest kinship shall take precedence. A relative through both parents has priority over a relative through the father, and a relative through the father has priority over a relative through the mother. If they are equal in kinship, they shall share in the inheritance. Where both sides are present, two-thirds shall go to the father's relatives and one-third to the mother's relatives, and the share of each side shall be divided in the foregoing manner. The provisions of the two preceding divisions shall apply to the third and fifth groups.
