Article 61 of Disability Law

Without prejudice to any more severe penalty prescribed by another law, any person charged with caring for a person with a disability, whatever the source of that obligation, who neglects to perform their duties towards that person or to take the measures necessary to perform those duties, or refrains from fulfilling their obligations, shall be punished by imprisonment for a term not exceeding one year and a fine not exceeding one thousand Kuwaiti dinars, or by either of these two penalties. The penalty shall be imprisonment for a term not exceeding three years and a fine not exceeding three thousand Kuwaiti dinars, or either of these two penalties, if such neglect results in harm to the person with a disability. If this results in the death of the person with a disability, the penalty shall be imprisonment for a term not exceeding five years and a fine not exceeding five thousand dinars, or either of these two penalties. In the event of recidivism within three years from the date of the final judgment, the penalty shall be doubled.
