Article 101 of Bankruptcy Law

The Bankruptcy Judge may, upon a reasoned application submitted by the trustee, a creditor or the Bankruptcy Committee—as the case may be—decide, within ten days from the date of submission of the application, to prohibit the debtor, its board of directors or its managers from managing its assets and business and to entrust that management to the trustee. In this case, the trustee shall have all the powers of the debtor, its board of directors, its executive management and its general assembly, with respect to dispositions requiring the approval of the general assembly, unless the Bankruptcy Judge decides otherwise. In all cases, the Bankruptcy Judge’s decision accepting or rejecting the application must be reasoned.
