Article 116 of Bankruptcy Law

A creditor who has not submitted the documents supporting his debt within the period specified in Article 104 of this Law may submit an application to the trustee for their acceptance and for participation in the proceedings, and approval shall be given to Index of the Law 1415 Home Page Bankruptcy Law Law No. 71 of 2020 Promulgating the Bankruptcy Law the trustee’s consent thereto by the Bankruptcy Judge. The list of debts shall be amended and notice thereof given again, and this creditor shall recover his debt from distributions made subsequent to the date of acceptance of his debt. If the trustee rejects the creditor’s application or does not respond to it within ten days from the date of its submission, the creditor may submit an application to the Bankruptcy Judge for acceptance of the submission of the documents supporting his debt. The Bankruptcy Judge shall issue a decision accepting or rejecting the application within ten days from the date of submission of the application. If he orders acceptance of the debt, the list of debts shall be amended accordingly and the trustee shall give notice thereof again. The Bankruptcy Judge may instruct the trustee to submit a report on the extent of the new debt’s effect on the draft plan and to submit it to him for ratification. In all cases, the proceedings provided for in this Part shall not be stayed. Chapter Three Conduct of Restructuring Proceedings Section One Preparation of the Restructuring Plan
