English translation
An application for annulment or rescission of the composition shall be submitted to the Bankruptcy Administration by a creditor, accompanied by all documents, data, and information demonstrating the existence of either of the two cases of invalidity of the composition or the existence of a ground for rescission. Within ten days of submission of the application, the Bankruptcy Administration shall notify the creditors of the application and its attachments, and shall also notify the debtor, the bankruptcy trustee who had been appointed to administer the bankruptcy estate, and the Bankruptcy Committee if the indebtedness was subject to its supervision. The debtor shall respond to the application within ten days from the date of notification, and the trustee may submit any observations he has on the application within the same period.

يقدم طلب إبطال الصلح أو فسخه إلى إدارة الإفلاس، من أحد الدائنين، مرفقاً
به كافة المستندات والبيانات والمعلومات الدالة على تحقق إحدى حالتي بطلان
الصلح أو على تحقق سبب الفسخ، وتقوم إدارة الإفلاس، خلال عشرة أيام من تقديم
الطلب، بإخطار الدائنين بالطلب ومرفقاته، كما تخطر به المدين وأمين التفليسة الذي
كان معيناً لإدارة التفليسة ولجنة الإفلاس في حال كانت المديونية خاضعة لإشرافها.
وعلى المدين أن يقوم بالرد على الطلب خلال عشرة أيام من تاريخ إخطاره، ويجوز
للأمين إبداء ما لديه من ملاحظات على الطلب خلال ذات المدة.Ask about this article
