Article 246 of Bankruptcy Law

If the sale contract is rescinded by a judgment or pursuant to a condition in the contract before issuance of a decision opening proceedings for a declaration of bankruptcy in respect of the purchaser’s indebtedness, the seller may recover the goods, securities, shares or real estate from the debtor’s assets if they exist in kind. Recovery shall be permissible even if rescission occurs after issuance of a decision opening proceedings, provided that the action for recovery or rescission was brought before issuance of the aforesaid decision. The applications for recovery provided for in this Section shall be submitted to the Bankruptcy Department, accompanied by documents demonstrating the recovery applicant’s entitlement to his request. The Bankruptcy Department shall notify the debtor, creditors, trustee and Bankruptcy Committee, if the indebtedness is subject to its supervision, of the application and its attachments within ten days from the date of its submission. Each of them may express his opinion on the application within ten days from the date of its submission. The bankruptcy judge shall decide on the application within ten days from the date of expiry of the period specified for responding to the application.
